1. Scope and Application

These Terms govern the general use of the India Elements website and establish the general principles applicable to enquiries and professional engagements undertaken directly by India Elements.

Specific services, projects, events, productions, consultancy assignments and other professional engagements may be governed by separate proposals, quotations, contracts or written agreements.

Where a specific written agreement contains provisions applicable to a particular engagement, those provisions shall govern that engagement to the extent permitted by applicable law.

2. Website Use

Visitors may use the website to learn about India Elements, review its practice areas and portfolio, and submit legitimate business enquiries.

Visitors must not:

  • Use the website for unlawful, fraudulent or misleading purposes.
  • Attempt to gain unauthorised access to the website or its systems.
  • Interfere with the website’s security or operation.
  • Submit materials that unlawfully infringe the rights of others.
  • Misuse website forms or communication channels.

India Elements reserves the right to take reasonable measures to address misuse or unauthorised activity, subject to applicable law.

3. Enquiries and Proposals

Submitting an enquiry through the website does not automatically establish a contractual relationship or guarantee acceptance of a project or professional engagement.

The scope of services, deliverables, fees, payment terms, timelines, responsibilities and other relevant conditions shall be established through the applicable proposal, quotation, contract or written agreement.

Unless expressly agreed otherwise, an engagement shall be considered confirmed only after the necessary terms have been mutually agreed upon by the relevant parties.

4. Cancellation by a Client

A client wishing to cancel an engagement undertaken directly by India Elements must submit a written cancellation request through the communication channel specified in the relevant agreement.

Where no specific communication channel is provided, the request may be submitted to the official contact email address published on the India Elements website.

The consequences of cancellation shall depend on the applicable agreement and may take into account:

  • Work completed up to the effective date of cancellation.
  • Services already delivered or performed.
  • Resources, personnel or infrastructure committed to the engagement.
  • Third-party bookings, contractual commitments and non-recoverable expenses.
  • Cancellation charges or notice periods agreed upon in writing.

Any amounts payable or refundable following cancellation shall be determined in accordance with the relevant agreement and applicable law.

5. Cancellation, Postponement or Modification by India Elements

If India Elements is required to cancel, postpone or substantially modify a service, project or professional engagement, it shall make reasonable efforts to communicate the relevant circumstances to the client and determine an appropriate resolution in accordance with the applicable agreement.

Where appropriate, the parties may mutually agree upon revised timelines, alternative arrangements, modifications to the scope of work or other practical measures.

Any refund, payment adjustment or settlement arising from such cancellation, postponement or modification shall be determined in accordance with the applicable agreement and law.

6. Events and Third-Party Commitments

Event management, production and other professional engagements undertaken by India Elements may involve arrangements with venues, artists, technical service providers, accommodation providers, travel operators, equipment suppliers, vendors and other third-party service providers.

The cancellation, postponement, rescheduling or modification of such arrangements may be subject to the contractual terms, cancellation charges, non-refundable commitments and other expenses imposed by the respective third parties.

The allocation of such costs, including any applicable refunds, deductions or payment adjustments, shall be determined in accordance with the relevant contractual agreements and applicable law.
